By accessing or purchasing from lostpatinamercantile.com you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Acceptance of Terms
By using this website or placing an order you confirm that you are at least 18 years of age and legally capable of entering into binding contracts. If you do not agree to these terms please do not use this site or make a purchase.
2. Products & Descriptions
Lost Patina Mercantile sells authentic turquoise jewelry, western goods, and digital products. We make every effort to accurately represent each item through photography and written descriptions.
Because our jewelry is sourced from natural materials and handcrafted by artisans, slight variations in color, stone pattern, matrix, and finish are inherent and expected. These variations are not defects.
We reserve the right to limit quantities, discontinue products, or correct pricing errors at any time without notice.
3. Pricing & Payment
All prices are listed in US dollars. Prices are subject to change without notice. Lost Patina Mercantile accepts payment via major credit cards, debit cards, Shop Pay, PayPal, and Apple Pay.
Payment is processed securely through our payment provider. Lost Patina Mercantile does not store your credit card information.
You are responsible for any applicable taxes based on your shipping address. Sales tax will be calculated and added at checkout where required by law.
4. Orders & Cancellations
Once an order is placed it cannot be modified or cancelled. All sales are final. Please review your order carefully before completing checkout.
We reserve the right to cancel any order at our discretion — including in cases of pricing errors, suspected fraud, or product unavailability. If we cancel your order you will receive a full refund to your original payment method.
5. Shipping & Delivery
We ship to addresses within the United States. Orders are processed within 1-3 business days. Shipping times vary by carrier and destination and are estimates only — we cannot guarantee delivery dates.
Lost Patina Mercantile is not responsible for delays caused by the carrier, weather, customs, or other circumstances outside our control.
Risk of loss and title for items purchased pass to you upon delivery to the carrier. If your package is lost or damaged in transit please contact the carrier directly. We are happy to assist in filing a claim where possible.
We recommend purchasing shipping insurance for high-value orders at checkout.
6. Digital Products
Digital products — including ebooks, printable journals, planners, and other downloadable files — are delivered electronically upon purchase confirmation.
All digital product sales are final. No refunds are offered on digital downloads once the file has been accessed or downloaded.
Digital products are licensed for personal use only. You may not reproduce, resell, redistribute, or share our digital products in any form without prior written permission from Lost Patina Mercantile.
7. Intellectual Property
All content on lostpatinamercantile.com — including text, photography, graphics, logos, and digital product files — is the property of Lost Patina Mercantile and is protected by applicable copyright and intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any content on this site without our express written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Lost Patina Mercantile shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or purchase of our products.
Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the State of Michigan.
11. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the site after changes are posted constitutes your acceptance of the revised terms.
